Matejic Consulting Group Pty Ltd (ABN: 45 648 783 788) (“MCGX,” “we,” “us,” or “our”) provides its content on its website at https://mcgx.com.au and any related applications or platforms that link to these Terms of Use (collectively, the “Site”) subject to the following terms and conditions (the “Terms”).
By accessing and using this Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

1. Copyrights and Intellectual Property

3. Permitted Use of Site Content
MCGX grants you a limited, non-exclusive, non-transferable, revocable license to:
- Access, view, and download Site Content for your personal, internal, non-commercial use only
- Download whitepapers, reports, case studies, and other materials made available for download
- Print one copy of Site Content for your personal reference
You must:
- Retain all copyright, trademark, and proprietary notices on any downloaded materials
- Not modify, alter, or create derivative works from the Site Content
- Not remove or obscure any disclaimers, attributions, or legal notices
You may not:
- Redistribute, republish, sell, license, or commercially exploit any Site Content

The license granted in this section terminates immediately if you fail to comply with these Terms. MCGX reserves the right to take legal action, suspend access, or pursue any other remedies for non-compliance.

When using the Site, you agree that you will not:

- Contains viruses, malware, or other harmful code
- Is unlawful, threatening, defamatory, obscene, or invasive of privacy
- Infringes intellectual property or other proprietary rights

- b) Attempt to:

5. Downloads and Whitepapers
Certain materials on the Site, including technical whitepapers, case studies, and industry reports (the “Downloadable Materials”), are made available for download.
By downloading these materials:
- You acknowledge that they are provided for informational and educational purposes only
- You agree to use them solely for internal business evaluation and not for redistribution
- You understand that the Downloadable Materials do not constitute professional advice or recommendations specific to your circumstances
- All terms in Section 3 regarding permitted use continue to apply

- MCGX is not engaged in rendering professional services to you through the Site

- Technical information, case studies, and examples are illustrative and may not apply to your specific circumstances

- b) No Confidentiality: Do not submit confidential or proprietary information through the Site unless covered by a separate written confidentiality agreement. Submissions made through the Site are not treated as confidential unless explicitly agreed in writing.
- c) Waiver of Rights: You waive any claims against MCGX for alleged infringement of privacy, publicity, moral rights, or attribution rights in connection with our use of your Submissions.

TO THE MAXIMUM EXTENT PERMITTED BY AUSTRALIAN LAW:

9.2 Limitation of Liability

9.3 Maximum Liability
In no event shall MCGX’s total aggregate liability to you for all claims arising from or related to the Site exceed AUD $100.
9.4 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer rights or guarantees under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or other applicable law that cannot be lawfully excluded.
10. Indemnification
You agree to indemnify, defend, and hold harmless MCGX and its directors, officers, employees, contractors, agents, and affiliates (collectively, “MCGX Indemnified Parties”) from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:
- a) Your use or misuse of the Site or Site Content
b) Your breach of these Terms
c) Your violation of any law, regulation, or third-party rights
d) Your Submissions or communications with us
e) Any negligent or wrongful conduct on your part
MCGX reserves the right to assume exclusive defense and control of any matter subject to indemnification by you, at your expense.
11. Modifications and Availability
11.1 Changes to the Site
MCGX reserves the right to:
- Modify, suspend, or discontinue any aspect of the Site at any time without notice
- Update, remove, or change Site Content without liability to you
- Restrict or terminate your access to the Site for any reason
11.2 No Liability for Downtime
The Site may be unavailable due to maintenance, technical issues, or other reasons. MCGX is not liable for any damages, data loss, or business interruption resulting from Site unavailability.
12. Copyright Infringement Notifications
MCGX respects the intellectual property rights of others. If you believe that content on the Site infringes your copyright, please provide us with written notice containing:

b) Identification of the allegedly infringing material and its location on the Site
c) Your contact information (name, address, telephone number, email address)

13. Governing Law and Jurisdiction
These Terms are governed by the laws of Western Australia and the Commonwealth of Australia, without regard to conflict of law principles.
You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the courts located in Perth, Western Australia. You consent to the personal jurisdiction and venue of such courts and waive any objection based on inconvenient forum.
14. Severability and Waiver
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
MCGX’s failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to in writing.
15. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published on the Site, constitute the entire agreement between you and MCGX regarding your use of the Site and supersede all prior understandings or agreements (whether oral or written) regarding such use.
